Terms of sale
Last updated :
Purpose
These terms govern the services supplied by Eurastech: audits, one-off troubleshooting interventions, and maintenance and monitoring subscriptions. They apply to every order unless specific terms are agreed in writing by both parties.
Services
The audit is a one-off analysis: performance and availability, security and configuration, backups and extensions, checkout and payment, risks and recommendations. It includes no modification of the site.
One-off interventions address a malfunction of the existing site, within the scope set out in the mandate.
The Essential, Business and Guardian subscriptions include monitoring, backups, updates and — for Business and Guardian — a monthly allowance of correction hours. Those hours cover fixes to the site's existing behaviour. They do not cover new feature development, redesign or platform migration, which are quoted separately. Unused hours do not roll over.
Intervention mandate
No intervention starts without a written mandate setting out the scope, the access granted, the existence of a verified backup and the rollback plan. The client warrants that it holds the necessary rights over the site and the hosting concerned, and is entitled to grant that access.
Access granted is named, temporary and limited to what is strictly necessary. The client undertakes not to disclose any master password or banking credentials, which BugRescue Maroc never requests.
Prices and payment
Prices are stated in Moroccan dirhams, excluding tax. Moroccan VAT at 20% is added to the invoiced amount.
Audit: 199 DH, deductible from the first month of a subscription taken out within thirty days. Subscriptions: Essential 349 DH per month, Business 699 DH per month, Guardian from 1,299 DH per month. Work outside a subscription: 450 to 700 DH per hour at standard rate, 700 to 1,000 DH per hour for emergencies, or 2,500 to 3,000 DH for a five-hour pack.
A 50% deposit is payable before any one-off intervention. Subscriptions are invoiced monthly in advance. Late payment leads, after a formal notice left without effect for fifteen days, to suspension of the service and application of statutory penalties.
Response times and availability
The stated response times — under twelve working hours on Business, under four hours on Guardian — relate to taking the request in hand, not to resolving the malfunction, whose duration depends on its nature and on third-party dependencies.
A contractual service level commitment is available with the Guardian plan; its terms, indicators and remedies are set out in a separate document annexed to the contract.
Obligations and liability
BugRescue Maroc owes an obligation of means, not of result. The nature of the incident, the initial state of the site, the quality of existing backups and third-party dependencies — host, extension vendor, payment provider — may prevent restoration. In that case the rollback plan is applied and a report documents the actions taken and the limits encountered.
BugRescue Maroc's liability is limited to the amount actually paid by the client for the service concerned. Indirect damage is excluded, in particular loss of revenue, loss of data predating the intervention, loss of customers or reputational harm.
The client remains responsible for the compliance of its own business, its own terms of sale and the processing of its customers' data.
Term, termination and governing law
Subscriptions run for one month and renew tacitly. Either party may end one in writing on thirty days' notice, without penalty. Amounts due for the current period remain payable.
BugRescue Maroc may suspend a service in the event of non-payment, unlawful use of the client's site, or refusal of the minimum security conditions set out in the mandate.
These terms are governed by Moroccan law. Failing an amicable settlement, any dispute falls within the jurisdiction of the courts of Casablanca.
